Privacy Policy

1 The real estate agent processes personal data from the tenant candidate in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter: GDPR).

2 The real estate agent collects and processes the personal data of the tenant candidate for real estate mediation purposes (i.e. finding tenant candidates and submitting their application to the rental client) as well as for direct marketing purposes (i.e. informing non-selected tenant candidates of other rental properties that meet their search criteria).

3 Personal data is processed on the basis of Article 6.1 (a) (as the tenant candidate gives explicit consent to the processing through this form), Article 6.1 (c) (as the processing may be necessary to comply with a legal obligation resting on the real estate agent) and Article 6.1 (d) (as the processing may sometimes be necessary for the legitimate interest of the real estate agent to undertake) of the GDPR. Insofar as the processing of personal data is based solely on Article 6.1 (a) (consent), the tenant candidate always has the right to withdraw the consent given.

4 If necessary for the achievement of the stated purposes, the personal data of the tenant candidate will be shared with other companies within the European Economic Area that are directly or indirectly affiliated with the real estate agent or with any other partner of the real estate agent. The real estate agent guarantees that these recipients will take the necessary technical and organizational measures to protect the personal data.

5 The personal data will be retained for the period necessary to comply with legal requirements (including in the field of accounting and anti-money laundering legislation) and at least for as long as the legal limitation period in relation to the real estate agent runs (e.g. on the basis of anti-discrimination legislation).

6 The tenant candidate has the right to access his personal data at any time and can correct them (or have them corrected) if they are incorrect or incomplete. He may also - under certain conditions - have his personal data deleted, restrict its processing, and object to the processing of personal data relating to him based on Article 6.1 (f) GDPR. In addition, the tenant candidate has the right to obtain a copy (in a structured, commonly used, machine-readable format) of the personal data he has provided to the real estate agent and to have the personal data transmitted to another real estate agent. In order to exercise the above-mentioned rights, the tenant candidate is requested to send an email to the real estate agent's email address with a copy of the identity card.

7 The tenant candidate has the right to object free of charge to any processing of his personal data for direct marketing purposes.

8 The tenant candidate has the right to lodge a complaint with the Data Protection Authority (Rue de la Presse 35, 10000 Brussels - commission@privacycommission.be)
